Outlet box placement

I wonder if any AHJ would try proposing an objection based on dedicated electrical space above the box? :angel:

In the OP photo there is nothing shown that would violate that space - if you wanted to try that route. AHJ would also need to be consistent though and there very well is some places in the same structure that do have non electrical items above device boxes.
