SEC Conduit - tight squeeze

Concerns on this install:

1. Shared conduit with CATV.
2. Conduit does not appear to be type of this use.
3. Sloppy caulk at the top.
4. Should conduit have been complete for the entire length?

Any thoughts would be appreciated.

The pictures don't show the entire install but it appears the conduit is being used as a sleeve for a jacketed SE cable and other cables and I see no violation of the NEC.

May be a violation of 820.44(B), cant tell from pic. Looks like an old plumbing vent stack was used (nevermind- I didnt see the second pic). There is a possible violation of 820.44(F)(1). Are the splitters grounded there?
