Was it ever code to run a three phase panel with only two legs being switched at a breaker?
I will ignore the title of the thread as possibly misleading.
High leg delta: Only if the high leg does not actually go to that panel. :) You would have just a 120/240 3-wire feed then.

Corner grounded delta: Yes, the grounded conductor is not switched or protected against overcurrent (there is no possible source of current through it except from the two protected phase wires.) The MCB will be two pole and connections to any individual load will also have only the two hot wires switched and protected.
The third (grounded) phase wires to each load will be taken from the "neutral" bar (which is not actually a neutral in this case.)
