Failed Inspection

So the inspector came out yesterday and said it isn't code compliant. He cited 376.00 and said you cant have an open top enclosure. I dont intend to roll over on this. He also brought up the 30 conductors in a cross sectional area. We do not have any conductors crossing the "cross section" in my opinion. Anyone have any further insight or pictures where this has been used and passed?

The inspector called me Friday and said he doesn't believe an open top trough is code compliant because the NEC doesn't say it is.
It's not open. It's just not closed with sheet metal where the sheet metal has been cut away... and not all the top sheet metal has been cut away, so it's not an open top metal wireway. Facts are facts, Jack.

General consensus is the NEC is a permissive document, meaning: an installation is compliant if the means and/or method is not prohibited. Ask inspector where the NEC says you can't do what you did and provide the Code section violated.
