equipotential bonding

We have a project that the city inspector and GC say doesn't require equipotential bonding for a large reflection pool / fountain.
Aren't fountains and reflection pools covered by article 680.26?

The requirements for reflecting pools and fountains are found in Part V of Article 680. Unless the reflecting pool/ fountain has common water to a pool it doesn't have to comply with Part II of Article 680.

Here is the definition of fountain from Article 680.

Fountain. Fountains, ornamental pools, display pools, and reflection pools. The definition does not include drinking fountains.

So a reflection pool is not a pool, but in fact a fountain.

As Chris has noted whether or not said pool will require equipotenital bonding (and under what Parts of 680 they are covered) many times percolates down to the definitions within Section 680.2...


Permanently Installed Decorative Fountains and Reflection
Pools.
Those that are constructed in the ground, on the
ground, or in a building in such a manner that the fountain
cannot be readily disassembled for storage, whether or not
served by electrical circuits of any nature. These units are
primarily constructed for their aesthetic value and are not
intended for swimming or wading.



Permanently Installed Swimming, Wading, Immersion,
and Therapeutic Pools.
Those that are constructed in the
ground or partially in the ground, and all others capable of
holding water in a depth greater than 1.0 m (42 in.), and all
pools installed inside of a building, regardless of water
depth, whether or not served by electrical circuits of any
nature.
