230.70(A)(1) Trying to reason with my electrical inspector !

Electrical inspector wants me to move transfer switch where old panel was on concrete wall ??? the proble is as you come down the basement stairs the transfer on the side wall obstructs the short landing ,,,, 230.70(A)(1) states first available wall ,, but come on !!!
