UL 1838 and NEC 680

Looking for some help on this one. We have specified a fixture with a UL 1838 listing to be installed within 5' of the pool edge. 680.23 (A) (6) would appear to allow this as long as the power supply is listed for swimming pool use. The inspector is arguing that it needs to be UL 676 listed, however; this listing refers specifically to "underwater fixtures" and the code only refers to "listed low-voltage fixtures".

The inspector has also argued that 680.26 (7) requires all "fixed metal parts" to be bonded, however; I do not think a "light fixture", is a "fixed metal part". While the fixture is metal, 680.23 (A) (6) states "not requiring grounding".

Love for some opinions on this one. Thanks in advance.

*UPDATE* I should have clarified that we are currently under NEC 2014 in the Cayman Islands

The inspector has said that anything "in and about pool and spa areas" also refers to area (F) and requires UL 676 listing. This listing however which specifically refers to "underwater fixtures". NEC 680.23.jpg

We noted that the 2017 code it also says that "listed low voltage gas-fired luminaires" are permitted, so surely a gas-fired luminaire would not have a UL 676 underwater rating?

Seems to me that your case is stated well and that a "listed fixture" that does "not require grounding" and that is under the "contact voltage limited" and that is "fed by a power supply that meets the referenced code for a pool and spa transformer" should be compliant. The fact that the later code of 2017 states that gas lamps and fireplaces would also be allowed if meeting the same criteria seems that it would be common sense that the intent of this code exception should not require the fixtures to be UL 676 listed (submersible) since I don't know of any submersible gas lamps or fireplaces.

Hoping someone else with either experience on the same or similar issue can chime in and either thwart or support this reasoning and issue?
