10 foot tap rule?

Section 240.21 (B)(1)(4)makes the point of a conductor sized no less than 10 times the line side fuse of the tap disconnect. If I tap from a 400 amp service to feed a 20 amp load, I still size the conductors to the 20 amp load disconnect at 40 amps? Thanks

Yes, the minimum ampacity of the tap conductors is 40A for this application.
