Has the NEC ever defined what a structural ceiling is defined by, as referenced by the above section??? I have a panel that has water piping run over the top of it but the contractor plans on putting a "hard" gypsum fire rated ceiling at 7' and this piping would be above that ceiling, but within the 6' of dedicated electrical space above the panel...

The section you cite explicitly tells what a ?structural ceiling? is not. However, it does, at the same time, give us a hint of what might constitute a ?structural ceiling.? In your case, the question boils down to this: ?Does the ?hard gypsum? material add any strength to the building?? You would need to pass that by the AHJ, or perhaps by a building inspector. It should be noted that a fire rating is not relevant to the issue.
