Would the following picture represent a 110.26 violation with the ESS (battery) being in the panel space?

I wouldn't think it would be a an issue with dimension as they are likely within the limitations brought up by @infinity. Nor do I think I would count the powerwall as "foriegn systems" 110.26(E)(1)(b).

I agree, a foreign system wouldn't be connected with a raceway to the panel above it.

You're allowed up to 6" of encroachment so if it's 6" you're good.

Also the gateway has overcurrent devices in it and it is completely covered by the ESS.

If it's 6" or less it is code compliant. More than 6" then you'll need to get creative, something like this:

It's all deep except for the vertical pieces the disco is attached to.

Yes the vertical portion is 3/4" and the rest is 1½". I know what is depicted gets the job done but IMO it's kind of sloppy.

I was "specificer" than that.
