12-2 on 25 amp 2 pole A/C

Guessing it's related to an AC condenser unit disconnect. Sure, it's done all the time based on 240.4(G). You will however get arguements pertaining to running NM-B into an exterior disconnect based on 334.12(B)(4). It's done all the time in relation to AC disconnects and exterior mounted loadcenters typically for homes on slabs.

Here is the exact wording from a large national relocating inspection company on the report for the electrical

"OVERSIZED BREAKER PRESENT AT THE MAIN SUB PANEL, AC BREAKER #12 WIRE ON 25 AMP DOUBLE POLEBREAKER. WHEN A BREAKER IS OVERSIZED FOR THE RATED CAPACITY OF THE WIRE, THE WIRE WILL OVERHEAT

The circuit breaker is not oversized provided that it does not exceed the maximum overcurrent protective device rating marked on the AC nameplate. It is very common to have an AC unit that has a minimum circuit ampacity of around 16 amps and a marked Max overcurrent device rating of 25 amps.

This inspection company would do well to study Article 440 in regards to AC units before they make a statement like they did.
