12/3 THHN in 1/2 SCH 40

Would using 12/3 THHN in 1/2 SCH 40 underground be permissible under the NEC?

I'm running wire to a shed. There is a partial run that I will be redoing because the guy that put it in years ago used UF wire in 1/2 conduit, which I now see from reading the forum, is the wrong thing to do. I would like to just replace that UF wire with the Cerrowire 100 ft. 12/3 Black /White /Green Solid Copper THHN Wire and keep the 1/2 conduit that is there instead of digging it out but, I will if it's the legal or smart thing to do and replace it with 3/4.
