I have UPS design that has a remote by-pass switch with an output circuit to a 120 Volt panel. I would like to take a 120/240 volt panel and tie bus A-ph and B-ph together to make 120 Volt. I just don't know if this allowed by the NEC. Any suggestions would be greatly appreciated.

This would be allowed as long as you label the panel correctly so that nobody thinks that they could get 240 from a two-pole breaker. :)
If the panel has a main CB, you would have to take some extra precautions not to overload the panel bus or the feeder. You would in effect be paralleling two CBs.

You would be in danger of overloading the neutral bus but not the L1 or L2 bus.
