Is it the Intention of the 2002 NEC, Article 702, to PREVENT Businesses, Retail Operations, Restaurants, and the like to REMAIN OPEN for BUSINESS during Utility Outages, if the power is to be supplied by a "Portable Optional Standby Generator?? (Comment: The GenSet would be of sufficient capacity/KW to service the Establishments)

Operational permits during an emergency or power outage is under the jurisdiction of the Fire and/or Health Department and maybe code enforcement, but not the NEC...

Can you explain your concern in more detail?
 
Staying open would be up to the establishment. Article 702 is for an "Optional Standby System", the establishment could "opt" to use candles and Coleman stoves if they chose to do so.
