2005 NEC Battery Backup Question

Hi guys,

I've been searching for the answer to this and cannot find anything anywhere....the question is:

Is a battery backup device, like an APC Surge Protector/Battery Backup, permitted to be installed above a drop ceiling with lay in acoustical panels?

Feasibly the unit can be hard wired or left with it's plug attachment and properly supported for safety. I just want to know if it's legal to do so.

If flexible cord is involved in the connection process, take a look at 400.8(5).
