I have found out from our inspector the 2008 code does not allow nm cable to be installed in pvc conduit or carflex outside above grade. They consider this to be a wet location. Since mn cable is only allowed in dry locations this is now a violation. Has anybody else heard about this

Actually that as been a violation for a long time, in the 2008 NEC they just made it more clear.
The inside of a raceway is considered a wet location when the raceway itself is in a wet location.
