2017 210.8(B) commercial kitchen gfci

210.8(B) requires "single-phase receptacles rated 150 volts to ground or less, 50 amperes or less and three-phase receptacles rated 150 volts to ground or less, 100 amperes or less" in non-residential bathrooms, kitchens and rooftops to be GFCI-protected. A contractor is contending that a 50-amp 250-volt rated receptacle fed with straight 208v, no neutral, in a commercial kitchen is not required to be GFCI protected. Is he correct?
 
He is not correct. Just because there is no neutral ran with the circuit does not change the fact that the voltage to ground is 120V which is less than 150V which means GFCI protection is required.

This is new for 2017, past code cycles only required GFCI protection for 120V circuits in commercial kitchens.

I agree.

The OP is in Mass. which adopts the new code the year it's introduced, so he has to comply.
