Need to install nine 120 volt 20 amp circuits in a 100 a panel board there is only one 40 a 2 pole cb in the panel now since the high leg is only going to be used for the 40 a cb would being unbalanced pose a hazard and if so is there another option.

A high-leg panel, aka a Delta or possibly an open Delta, is often "expected" to be imbalanced, as far as the high-leg is concerned.

In your case, you could ignore the high leg completely, or place the 2p breaker between the high-leg and whichever bus has fewer 1p's.

Either way, your load is probably easy enough to not worry about the balancing issue. Think about your loads as you land the home runs.
