210.52(5) e2 kitchen countertop outlets

210.52(5) e2. If I have a window that comes all the way to the surface of a kitchen counter top (not peninsula or island), does this exception allow me to not install a receptacle? Yes, I know about pop up receptacles.

There is no exception for a window to bypass the 2'/4' countertop spacing rule.

There are some who believe if there is a window then there isn't a wall so no receptacle is required, however not all inspectors will see it that way. I think the exception will allow you to mount the receptacle at the front or end of the cabinet not more than 12" below the countertop

Dennis, in general don't windows count as wall space? Floor to ceiling windows would require a floor receptacle.

The window is roughly 4 1/2' wide, and falls in the middle of the lower cabinets. The cabinet in question has drawer space, so there isn't any place to make that happen. In reality, we left a wire blanked off in said location for a pop up receptacle and can comply, but the customer doesn't want it.

With the window at 4.5' wide one at each edge of the window might be close enough to pass inspection even though it's not code compliant.

I installed sillite receptacles facing each other in the window framing. You can also face them up in the sill since that is not a work space.

After reading it again (and again), I was wrong. 210.52(5) ex 1 and 2 says that "outlets shall be permitted to be mounted not more than 12" below the countertop or work surface (2) ... work surface where the surface is flat across its entire surface (no backsplashes, dividers, etc.)and there are no means to mount a receptacle within 20" above the countertop or work surface...
In the end, it's fine, it is new custom work and we anticipated and communicated this beforehand with our customer, pop up receptacle it is.
