230.40 exception 1

Consider the following setup: three family dwelling, three floors plus basement, one dwelling unit per floor, basement accessible to all tenants. Three gang meter with no disconnects, one SEU to service panel on 3rd floor, two SEU's to two grouped service panels in basement for first and second floors. Does this meet the spirit of 230.40 exception 1?

No, and I assume there are 3 meters but that does not make it 3 services. It appears you have one service and I read that to mean disconnects must be grouped.

But you agree that if each service panel was in each respective unit then it would be ok? One could argue that it is better to have two of the three grouped and one ungrouped then all three ungrouped, the latter case being code compliant.....
