240.21.B.4 Taps

In regards to the above section, if I run a #6 from the source I want to tap from (208 - 3 phase - 70 amp)to a 3 phase 20a fused disconnect, and from the load side of the 20a disconnect to my new piece of equipment, will this satisfy the requirement. Total length of the run is about 35' (20' hozizontal - 15' vertical). I plan on using EMT. Everything is protected from physical damage.

This section doesn't apply if you use #6 from the tap (splice) to the 20A fused disconnect. If you intend to use this 25 ft tap rule, you must shorten the run to 25 ft. :D

Have you considered just using #4 AWG for the tap? Then it would not be a tap, since the #4 would be rated for 70 Amps. Just a thought.
