240.24(A) Maximum height?

In regards to 240.24(A), wording of this article only includes over current protection devices installed? Wording does not include empty slots with breaker blanks, filler plates with bussing for future breaker installation? Is this correct and is that the intent? Opinions and interpretations welcomed. Thanks.
 
I try not to be a “what if” inspector but I bring it up and look at options to have them provide a work platform. Just had this come up on a club house inspection and all agreed on the platform.
 
Since that section specifically states that the measurement is taken "so that the center of the grip of the operating handle of the switch or circuit breaker, when in its highest position" I don't see how a blank section that has no grip of the operating handle matters. What someone may or may not do in the future is irrelevant.
 
As noted in the difference between Post #2 and #3, I think you are in an AHJ decision category.
I tend to enforce along with what infinity states but walk away concerned that it is highly likely that it will lead to a violation one day.

I know what it says but there are relatively simple fixes that I try to resolve so they don’t become existing on top of existing conditions as we have to deal with in the future. I am sure I will get crushed on that by the forum.

Thanks. During inspections I put on my electrician hat along with my inspector hat and seems to have built a purty good relationship so far. Been tough here in Indy compared to working with local 26 in our Nations Capital.
 
This is similar to the discussion about whether the six-breaker-limit is exceeded with panels that will accept more.
 
What about 40 amp fuses in a 60 amp safety switch; what assurance does anyone have that someone wont install larger fuses down the road?

If's go on forever. Some are reasonable, some are not even close.

I had put some spare circuits in the attic. An inspector said they need to be AFCI . His reason was 'If ' some one pulls the circuits down in the house. I said , no those are for igniters 'IF' some one builds a rocket launcher in the back yard.
