3-phase panel with 1-phase service

This structure is an older strip mall with about 6 units.
Each one has its own service and meter. Everything is single phase feeding each of the units.
I’ve done work in several of the units.

One unit I’m currently doing work in I was surprised to take the panel cover off and find out it was a 3-phase panel.
The thing that really threw me for a loop is that there’s a 2-pole 100-amp breaker that is providing power from L2 -> L3!
In other words, the 100 amp breaker is stabbed onto L2 & L3 bus and has a jumper wire from one lug to the other lug. The jumper wire looks to be about a #2.

I know this structure never had 3-phase, I talked with the poco they said 3-phase isn’t currently available at this location. I’m confident the panel is original to the building based off what I’ve seen in the other units.
I think the EC just had a 3-P panel left over from another project and “made it work”!

Barring the fact that this probably violates its UL listing, and the fact that L2 & L3 are the same phase (I gotta keep that in mind if I put a 2-pole breaker in!), what other major issues and concerns are there about this setup?
