3 wire romex ?

New to the forum, but have been lurking before.

I have a new house with a framed and floored attic space I am trying to build out. I am on the electrical right now and I found the panel has 2 15 amp circuits, 1 labeled attic, and 1 labeled attic spare. There is currently 2 temp lights and an outlet up there.

I took the panel cover off and found it's actually a 3 wire romex, with the red wire on its on 15 amp breaker and it's the one labeled "attic spare". The black hot wire is on the other breaker and feeding the attic lights and outlet, red is capped off in junction box.

Is that allowed? Trying to do this to code and have never seen that done.
