Can this code reference be applied to a residential duplex with overhead service entrance conductors or would the fact that there are two main panels under one roof be interpreted as two structures?

I believe this is often considered 2 structures but you need to check with the building inspection. If there is a firewall between the units up thru the attic then my bet is it is 2 structures
