Situation
4? square box with blank cover, ?? emt in and out, installed 2? below a 24? overhang on the side of a building.
2005 NEC 314.15(A)
Paraphrasing:
In damp location?..shall be placed?moisture from ?accumulating within the box.
I say no violation, What say you????
 
If I understand correctly, I don't see how moisture from rain, etc. could enter the box, so I agree, no violation. You might want to address 300.7 and seal the conduit.
 
These questions require that you check out the definitions of Location,Wet, Location,Damp and Location,Dry in Article 100. Once you have determined the type of location then you can determine what needs to be installed there.
 
I'm not so sure on that one....I've seen it rain sideways in my neck of the woods with a stiff wind at 30 knots.

Why not just use a weather proof box and cover?
 
He could certainly argue that a 4" box has enough holes to prevent water accumulation.

I would install a W/P box without having to be compelled to.

This appears to be a gray area according to Rob's advice; it seems to be damp, not wet.

I, also would install a WP box because of the rust or corosion factors.

The way I read the section is the word "or" gives one the option no water entering or no accumulation
Yes there are other items involved, but I wanted to keep this to just the box in question.
And there is a reason it`s a desert here in las vegas?..it does not rain !!!! ha
