352.26 Exception for Duct Banks

Is anyone aware of an exception to NEC 352.26 for duct banks? Our pull calculations show no issue with the added bends due to oversized conduit but the EOR will only sign off with a variance for the AHJ. Unfortunately the job schedule does not allow for us to apply for a variance and wait for a decision.

Pull calculations also take into consideration sidewall pressures going past a circle?
Don’t have a book in front of me but I believe every article in 35_.26 is bends, and there all the same.
 
There is no provisions in the NEC that permits you to use the results of a pulling calculation to increase the degrees of bend between pull points. The AHJ would have to provide a written special permission you to be able to do that. Such permissions are rare.
