A few questions.

1. 358.12(1)- Isn't this left up to interpretation.
2. I thought EMT could not be used for MV wiring or systems over 600v. I don't see this listed.

This, along with many other code rules, is a very subjective rule and subject to interpretation.
2. I thought EMT could not be used for MV wiring or systems over 600v. I don't see this listed.
EMT can be used for conductors of systems that operate over 600 volts.
 
Also why is EMT always not permitted per specs not to be used in the slab on grade? According to 358.12 it can be if covered by at least 2" of concrete.

Because it is in the best interest of the people that write specs for the job to be as expensive as possible.....

Seriously:
Lots of things are prohibited by specs that are allowed in the NEC. That is why there are specs, to require things above and beyond the NEC. If all we needed to do is meet the NEC minimums there would be no need for specs.
