4/3 NM cable as dwelling feed

Existing single family dwelling built in the mid 80’s.

Load center is being fed with 4/3 NM cable from an exterior disconnect protected by a 100 amp breaker.

Am I correct in saying that wasn’t even compliant when it was new?

I’m looking to upgrade the service . Will have an 8 space 3R 200 amp main breaker panel adjacent to the meter.

Will that now need to be reduced to a 70 amp breaker because the NM rating for the 4/3 is 60 degree and it’s not feeding the entire dwelling?

I will be adding an EV charger and taking that load from the new panel outside.

If it were SER then #4 could be used if it carries the entire load. NM cable no good.
