400 amp service rated ATS

I got a call from a contractor who wants to install 1 400 amp service rated ATS to feed two existing 200 amp main breaker electrical panels, electrical panels are back to back of existing 400 amp meter socket (less than ten feet), he wants to run 3/0 copper from the the 400 amp breaker in the ATS to each 200 amp electrical panel. I am not sure if that complies with the feeder tap requirements, connecting directly to the breaker.
 
The 400 amp breaker in the ATS sounds more like it would be the service disconnect and his 3/0 feeds to his panel would normally connect to the lugs on the switching contactor.
If he has lugs rated for two conductors, it sounds like the install will meet the tap rules.
Has he given any thought to Art 702.5(B)(2) ?
