404.4(C) Definition of tub space

I have a bathroom remodel in a very old house with a tub that has no shower right next to the bathroom door,.
There is a electric heat thermostat and some switches directly above the tub in a location normally expected to be dry.
When I said I would of course move the switches the HO objected, indicating the bathroom was previously remodeled and those switches were inspected and passed so now i am looking into the code.
I could move the switches about 6 inches over that would place them directly next to the door out of the imaginary shower zone.
But that is still easily within reach of the tub.
Old threads on this confirm my suspicion that the definition of tub and shower space in Article 406 is not used in article 404.
I am going to propose putting the switches outside the bathroom door, but wanted to here other thoughts.

EDIT I should add there is a very nice shower in same bathroom, so zero chance tub will become a shower.
