Have a 240v 5 hp single phase motor that will be used to fill spray tanks on a farm. Motor does not have thermal protection and is continuous duty rated motor,am I required to provide overload protection?

Nameplate has a fla of 19.7, table in 430 list fla as 28 should I base overload protection on nameplate

Unless the motor has internal protection fitted, I would fit external protection whether or not required by code or any other applicable regulations.
But I usually design conservatively.

Yes. You should provide overload protection based off of the nameplate FLA and ground fault short circuit protection off of the FLC.

The tables in the NEC are to be used for sizing the conductors. When sizing the OL relay, you always use the motor nameplate FLA, then select heaters or adjustments only by reading the instructions that come with your OL relay. The final steps are not all done the same way between brands, but you always start with the motor nameplate data.
