60 KW GENERATOR - 200 AMP S.E. ATS

I have a homeowner that was given a 60 KW generator that has a 300 amp CB. The homeowner has an existing 200 amp S.E. ATS. Is this scenario permitted by the NEC as the 3/0 cu would be protected by the 200 amp main? Does 240.21 B (5) apply?
 
IMO, the fly in the ointment is "(2) The tap conductors terminate at a single circuit breaker or a single set of fuses that limits the load to the ampacity of the tap conductors. This single overcurrent device shall be permitted to supply any number of additional overcurrent devices on its load side"
The generator side of your ATS does not likely provide this.
