680.22 ???

I am involved with an installation of lo voltage lighting, spa, & water feature.
The exterior spa & water feature/fountain have common water requiring Part II of 680 to be enforced. This water feature is a water fall "wall" within 5' of of spa and has 24v DC wet location led strips highlighting the side cove. The power supply is in compliant with 680.22(B)(6). Water does pass over the luminaire.
I am concern the luminaire should be compliant with 680.23(8) but the driving statement for 680.23 is " This section covers all luminaires installed below the maximum water level of the pool." Clearly the luminaire is "not" below the maximum water level of the pool.

I appreciate all code specific comments to confirm or relieve my concerns.
 
680.22(B) in the 2014 has a new section. The fixture and trany must be listed for pool area. These tranies are usually the isolation type

(6) Low-Voltage Luminaires. Listed low-voltage luminaires
not requiring grounding, not exceeding the low voltage
contact limit, and supplied by listed transformers or
power supplies that comply with 680.23(A)(2) shall be permitted
to be located less than 1.5 m (5 ft) from the inside
walls of the pool.

680.23(A)(2) Transformers and Power Supplies. Transformers and
power supplies used for the supply of underwater luminaires,
together with the transformer or power supply enclosure,
shall be listed for swimming pool and spa use. The
transformer or power supply shall incorporate either a
transformer of the isolated winding type, with an ungrounded
secondary that has a grounded metal barrier between
the primary and secondary windings, or one that
incorporates an approved system of double insulation between
the primary and secondary windings.
 
I can only assume due to so many views & only 1 response that the only section applicable for this circumstance 680.22(6)(B). The luminaire is not required to be listed for a pool.
It is a bit disturbing the lack of comments due to the unusual circumstances. FYI this is why I use the forum resources as there are many qualified professionals with varied opinions (but not in this case).
 
411.4(B) Pools, spas, fountains and similar locations. Lighting systems shall be installed not less than 10 ft horizontally from the nearest edge of the water unless permitted by article 680.
