70e 2009

I was on the NFPA site last night and noticed they are taking advance orders for the 2009 edition of NFPA 70E. The release date for the standard is some time in September.

When will OSHA recognize the new document in terms of enforcement? January?

Joe, I don't know if this was an honest answer but at the Arc Flash seminar I was at last week the instructor said that the 2009 was going to be enforced by OSHA "on publication". I thought that there was like a 60 or 90 day period between publication and enforcement, maybe they mean business with 70E?

OSHA did not adopt 70E in the last go-around as there were too many unanswered questions as the accounting for all the variables when performing the calculations.
OSHA will cite the "General Duty Clause" when citing a violation of 70E stating that it is a concensus document and that the employer knew what was required and that compliance with 70E will satisfy OSHA's safety requirements.
I believe the IEEE and NEMA are working on a joint project to quantify the variables in an arc flash to be more acceptable to OSHA when it gets around to reviewing 1910.

Just a heads up. It is out now. Mine was delivered here Friday or Saturday.
