The power company is liable. They didn't do an arc flash study. They didn't post arc flash warning signs, and they didn't prevent the guy from doing energized work. And lastly, they didn't provide proper PPE.

I checked today just out of curiosity... In the last 6 years, we have lost almost 5 MILES of copper line to thieves (6A &8A CWC).
Some come up with ingenious ways to get the neutral down. We had one Vee phase line that had only one phase hot. When they stole the neutral here, we made the unused phase line neutral. Im sure the thieves are wondering why we haven't replaced it. We are almost complete with all alum. now anyway..
