a/c motor loads

I have a a/c condenser with a min. ampacityof 34.5--- using table 310-16 and referencing 240.4(d) exception 240.4(g) ---- looking at 440.6 & 440. 22
Can I use a # 10 thhn conductor size fused at 50 amps?
According to the name plate rating the min ampacity is 34.5 and the max fuse is 50 amps--- As i red it this is totally acceptable

I would suggest going to a #8 THHN. Correct me if I'm wrong in this. 440.32 requires a conductor ampacity of 125% of the nameplate rating. This would be an ampacity of 43 amps. 440.6 requires the use of table 310.16 for the conductor rating. The smallest conductor at 75 C. would be #8.

The manufacture already did that calculation for you... #10 is allowed.

440.32 says what it says... What are going to do ... ?

Are you going to get that wrote out of the Code? There's a proposal section here!
