It would be interesting to make a few calls to other trades in your area that normally work on roofs and enquire about 'tile insurance'.
Perhaps the insurers in your area have isolated this sort of damage into a special rider on policies and Corky is legally allowed to operate without it.
By offering the client the option of taking a risk and not having him purchase it he can underbid a competitor who always carries it.
As for who is responsible for tile damage caused by the contractor when insurance isn't in place I haven't a clue. Call a lawyer. :)
