A/H Installation Question

I've got a question regarding an A/H installation. The garage panelboard contains a 60A circuit breaker labeled for the A/H. A #6 SER cable is installed from this panel to the A/H closet inside the house. The #6 terminates to a 60A panelboard disconnect containing a 60A non-automatic switch (breaker). Form there a short #6 SER whip connects over to the A/H and terminates to a 30A breaker installed in the unit. The A/H rating is 5kW.

Does this violate the code? The unit IS protected by the 30A OCD at the unit, however the branch circuit / feeder is rated at 60A.
 
I think it's fine. The purpose of a breaker is to protect the downstream conductors, not the load.
 
So based on 424.4, as long as the branch circuit overcurrent device and circuit conductors are rated at least 125% of the total A/H load, the installation should be approved. It does not appear this section places a maximum rating of the branch circuit overcurrent device and circuit, or do we default back to 422.11?
