has anyone heard of a new code in West Palm Beach that says that you need an inner duct or separate raceway to run fiber optic cable. The ceiling is not a plenum space.

There isn't a "new code" in West Palm Beach. They are on the 2005 NEC, period. I suggest you contact the local AHJ to find out what it is you are hearing or seeing.
