Abandoned conduit in fire rated wall

Hi guys, are there anything in NEC about abandoned conduit in fire rated wall? EMT conduit comes out of the fire rated wall a few inches. It has sleeve. Area around the sleeve and conduit itself caulked. Should I remove the conduit or can leave it in that way?

IIRC, the NEC talks about removing abandoned wire or cable, unless it's marked at each end, to the first junction box. That may also be for low voltage (~24 VDC?). As long as the conduit penetration has been fire-stopped using a UL-approved system, you should be fine. I might cap the end to keep junk from getting into it.

The NEC only requires that to be done with abandoned cables and conductors that were installed for Chapter 7 and 8 installations. There are no general rules requiring the removal of raceways, cables or conductors covered by Chapters 1-6. There a couple of specific rules in 372.58 and 374.58, but no general rules for power conductors.

I agree that if the EMT was correctly fire stopped at the time of installation, there should be no issue.
