ADA controller height

I don't know if this is the right forum, but here goes. I'm a contractor in San Francisco. We recently did some ADA accessible bathrooms and passed everything, except for the placement of the thermostats, which were placed by our HVAC contractor at 60" The inspector cited CBC Sec. 1117B.6(5.1):

?5.1. Electrical switches. Controls and switches intended to be used by the occupant of the room or area to control lighting and receptacle outlets, appliances or cooling, heating and ventilating equipment, shall be located no more than 48 inches (1219 mm) measured from the top of the outlet box nor less than 15 inches (381 mm) measured from the bottom of the outlet box to the level of the finish floor or working platform.?

The thermostats are going to be programmed and covered with a tamper proof thermostat guard , not " intended to be used by the occupant of the room". Furthermore, the building inspector passed the location at rough in framing.

Moving the thermostats will be difficult since the bathrooms are tiled.

I'm interested in your comments. We're going to dispute the ruling, but will probably move them anyway since a lot of money is still outstanding.

That's the end of the story. The inspector does not have an argument. Have the engineer change the design to call these Tstats "climate sensors"

I am not familiar with California's ada enforcement but here it does not matter if the occupant would use the device but for the employee who would be responsible may need wheelchair accessibility.
