AFI's in NY state

How about this one: My regular inspector does not require AFI's. He said that NY state never adopted that part of the NEC. That was all fine and dandy because i hate those things anyway, mostly because they cant be used on multiwire branch circuits. Recently however I did a rough in and had to use a different inspector because i was leaving town and my regular guy couldnt make it in time. This inspector said the exact opposite, that NY state DID adopt the AFI requirement. OH and it just so happened that the bedroom was on a multiwire, grrr. Does anyone know which inspector is right?
I am in rural central NY, so there should not be any local codes or modifications to NEC.

Last I knew NY had adopted the 99 NEC, which I believe required AFCI protection for bedrooms beginning 1/02.

My regular inspector said that the afi requirement had been repealed because they were not functioned well nor accomplishing what they were supposed to. The agancy is MDIA, anyone in NY have an MDIA inspector not require them?

(unless you have locally adopted amendments) Residential Electrical installations in NY State must follow the NY Residential Code which is based on the 1999 NEC, but omitted AFCI requirements.

Very interesting....

I wonder if any other states have dropped the AFCI requirements from their adpoted codes?

It seems like this issue will need at least a few more years to clear up. :(

Here are the basic rules for AFCI protection requirements in NY State, as per the NYSRBC.

1. All one and two family dwellings with a SINGLE PHASE service of 400 amps and smaller are NOT required to have AFCI protection. If the dwelling has a 3 phase service or the service is larger than 400 amps, you are required to install AFCI protection. (there are areas the dwellings were supplied with 3 phase 150 amp services - because of the wording of the NY Residential Building Code, these homes require AFCI protection of the bedroom receptacles)

2. ALL multifamily dwellings (3 family and larger) require AFCI protection, regardless of service size.

Interesting, the International Residential Code covers one and two family dwellings up to and including 400 amperes. Coincidence? :D

The NY State Residential Code is basically a modified IRC. My understanding is that NY must promulgate (?) rather than adopt codes.

To further elaborate on the original question, there is a section (E3802) in the NY Residential Code entitled "Ground-Fault and Arc-Fault Circuit-Interrupter Protection", but there are no requirements for AFCIs listed below it.

Right Bill, I looked also and couldn't find anything about service size. My information came from word of mouth and I thought AFCI's were required with 400 amp and above, not above 400 amp.

So Pierre, I have the 2002 Residental Code of NYS-where is it?

Hal sorry I am responding so late, I have been a little busy.
E3301.2 Scope - Page 411
..." Services within the scope of this code shall be limited to 120/240-volt, 0-to 400-ampere, single-phase systems."

This is part of the scope there is more that you can read, as you mentioned you have a copy.
