I read the note previously and found it to be sufficiently broad in scope and ambiguous enough to permit just about anyone to be the AHJ.
Somehow, I don't see the local electrical inspector deferring his judgment to the chief electrical engineer of a private firm.

That's why the NFPA designated it the Authority Having Jurisdiction. It could be the guy with the most political clout. It could be the guy with the biggest muscles. It is always a political issue, and beyond the scope of the NEC. Let the AHJs slug it out, or ask your local lawyer. In my state, for matters of the building code the local AHJ is the town's BO, and the state AHJ is the State Building Inspector. The dog catcher is the AHJ, by the way, for all matters dealing with stray animals. And, in my house, my wife is the AHJ for all matters dealing with home decoration.
Your issue is straight forward. The engineer is not the AHJ. The BO is the AHJ. If they disagree, there are avenues of appeal.

The code is written that way because there are many ares where the code has not been adopted by a governmental unit, or if it has been adopted, there is no inspection process.

I can see the chief electrical engineer steping in as AHJ if there is no local authority with that responsibility but to assume such responsibility universally makes me wonder if he is not overstepping his bounds.

I also know of areas where the inspector does not inspect any manufacturing occupancies. They leave the inspection to the electrical engineer and safety department.

:D Come on Earl we all know that our wives are the ultimate AHJ. :D There will be no challenging them to an appeals board. ;) You loose do it her way. :roll:

Years ago, I was a building inspector at Foxwoods Casino, owned by the Mashantucket Indian tribe in Connecticut. They are a "sovereign nation" and exempt from all state laws, including building inspection! The contractor pursuaded the Mashantuckets that he would inspect the work himself, and save a lot of time and money. Six years later they hired me and a few others to try to fix that mistake. I had to quit after two years because I could not get the AHJ power I needed. Items that did not meet code were sometimes overruled by the Indians because it would cost too much money or would take too long to complete. The timetable was more important than safety. A sad situation. (Just like at home, I am often overruled by the real AHJ. Yes, Dear.)
