Allowable Locations of Kitchen Appliance Receptacles

In a kitchen remodel where the required receptacles are located in the walls above the countertop, is it OK to relocate the receptacles to the underside of the cabinets above the counter? It would be 16 inches above the counter. Reason is that a tile backsplash is being installed up the wall and the desire is to avoid penetrating the tile with the outlets.

Receptacle outlets shall be located above, but not more than 500mm (20 in) above the, the countertop. NEC 210.52(C)(5) :)

Allows up to 20" above the counter top.
But keep in mind that 210.52(C)(1) requires receptacle outlets shall be installed so that no point along the wall line is more than 24 in. measured horizontally from a receptacle outlet in that space.
It should say " no point along the wall line is more than 24 in. measured from a receptacle outlet"
Which would be the intent of this code as kitchen appliances only have a 24" cord on them and they need to be able to reach a receptacle from anywhere on the counter top but It doesn't maybe a good code change for "2008"
