Amount of circuits in a panelboard

Is it permissible to have a breaker box of 42 circuits with a main breaker for 100 amps?

42 for 3 phase, 40 for single phase. Listed and sold by most manufacturers.

I remember some part of the code of 10% allowed for power or something that allowed panelboards to be increased to, as you say, 40 circuits. This ring a bell to anyone?

That code went away with the 2008 NEC. You can have unlimited circuit panels.

BTW Shep I saw a 42 cir. MB Cutler Hammer Panel and it was single phase. I was surprised.
