Ampacity and overcurrent protection

Table 310.16 not more than 3 current carrying conductors in a raceway lists#10 copper THWN-2 ampacity as 40 amps. Ok I never noticed the star before. I went to 240.4 (D) (7) looks like 30 amps Max overcurrent protection for all #10 awg copper. Is that correct? For all applications. I’m feeding a residential outdoor condenser unit.

If you go to the reference given by that footnote, 240.4(D), it will tell you in that the 30 amp max OCP applies EXCEPT for 240.4(E)or (G) and HVAC , Art 440 is one of the exceptions listed, therefor, for those items listed in (G) the 30 amp limit does not apply and you need to refer to that particular Article.

For the AC unit you can ignore the 30 amp limitation in 240.4(D)(7). If you're using NM cable your stuck with the 30 amps because #10 NM cable is limited to the 60 degree C ampacity which is 30 amps.
