Are the bonded to the tub - I'm kidding.:roll:

Are they listed for damp or wet location?

My worry would be that if someone slipped in the bath - they might grab a light - which would act as a fulcrum on the mirror - the mirror breaks and you got someone naked and wet, falling and lots of busted glass.

Otherwise the code is kind of silent on sconces - get away with it while you can..... ;)
 
Humm .,, C'est not listed for damp or wet location.

if the plumming pipes are copper and someone stand up and hold the luminaire if the luminaire wire for some reason go bad someone will have more than just a bad hair day there.

IMO get rid of them as long your ticker still working .,,,,,,

I'd say you have a 410.4(D) violation.The fixture is within the 8' zone and not listed for damp or wet locations.
 
I guess as far as the NEC the "damp location" issue comes into play.

But for me, I have no problem with them at all. Not anything I would be worried about.

Why do you consider this a damp location? I don't see a shower nozzle. Is the area above a sink a damp location?

I agree. It looks to me like the fixtures stick out into the footprint of the tub, if they do then I think the fixtures need to be listed for a damp location.

But they may not actually stick over the tub. It is hard to tell just by looking at the picture.
 
It only needs to be listed for damp location since it is not subject to shower spray and is within the zone (3') of the tub.

Edit--- Changed 3" to 3' but I know you all knew that. :D

This is where inspecters make there money.Its really pushing things and i dont like it even if gfci protected, but it does look like it might pass.Had it been me i think i would said no and refused to install.Now if they push this i have inspector and engineer taking the charges.We all can see proplem even if nec lets it slide.
