Approval of exceptions to NEC

We have a condition where rear access to 40 volt rectifiers is less than the 3 feet code requires. But the code says that for low voltage, disconnected equipment, approval may be granted for the compromised arrangement. Normal access is via the front panel, rear access is only rare.

Question: Who can approve the variation from code. The installation is in progress so we have to settle this quickly.

The AHJ according to the rules adopted in your area. In Indiana, AHJ is defined as follows:

(b) In Part 1 of Article 100, delete the text of the definition of AUTHORITY HAVING JURISDICTION and substitute to read as follows: AUTHORITY HAVING JURISDICTION. The office of the state building commissioner authorized under IC 22-15-2-7; the office of the state fire marshal authorized under IC 22-14-2-10; the local building official authorized under IC 36-7-2-9 and local ordinance; the fire department authorized under IC 36-8-17-9.

See section 110.3, and 90.4 enforcement. Also the art 100 definition of special permission means per 90.4 that special permission must be in writing.
In short, your AHJ deceides, if a condtion exists that requires a variance from the NEC, special permission must be in writing.

Here in Connecticut, all such variances from the code must be granted by the State Building Inspector. Oue "modification" system involves a form filled out by the contractor, commented upon by the local inspector, then decided on by the SBI. The "mod" is then added into the building permit file. Takes the responsibility and the liability away from the town.

If you can make a case that, on those rare occasions that you have to gain access from the rear, the equipment will be de-energized prior to opening the access panel, then the working clearances of 110.26 would not apply. There would be no need for a variance from the code. You?d need to sell the case to the AHJ, and it?s probably not an easy sell.
