Maybe because Joe is a former boxer? ;)

The lockout pictured would be great for LOTO for enhanced personal safety, but not for a permanent lockout means, like for a remotely installed motor or water heater, as the NEC requires. That one will more or less fall off when you take the lock off, I believe.

FWIW, it looks like a Brady 2-pole to me.
 
The whole "shall remain in place with or without..." is pretty vague. It doesn't necessarily mean that the place with the lock installed and the place without the lock installed need by the same place. I think that might be the intent, but it doesn't read that way. You could have a LOTO cabinet or box mounted on the wall right next to the panel to store them in when not in use, and possibly still comply.
